An Island trust is fighting back after the Scottish government ordered a patch of land to be sold to a community group to create a memorial garden to Mary, Queen of Scots.
In 2018 Scottish ministers said the disused site in Fife should be sold to Poet's Neuk under land reform laws.
But Forthtay, based on the Island, argued in court the decision shows bias and a number of planning applications had bene made to use the site.
Sheriff Niven, who's hearing the case at Dundee Sheriff Court, will make a written judgement.
